These terms apply when you visit Buildiy, create an account, manage a workspace, publish a hosted website, use a Buildiy product, or access a service supplied through buildiy.com.au.
Buildiy is intended for registered Australian businesses and their authorised users. By creating or using an account, you confirm that:
You are responsible for keeping your login details secure and for activity that occurs under your account or workspace. Tell us promptly if you suspect unauthorised access or misuse.
We may require email verification, password resets, security checks, captcha, or other safeguards before allowing access to the platform.
Buildiy provides software tools for Australian businesses. Current and planned features may include hosted websites, website templates, domain configuration, SSL support, website editing, SEO controls, basic website statistics, tenant management, email notifications, subscriptions, and other business utilities.
Some features are included only with certain product add-ons, may be marked as beta or early-access, or may change as the product develops.
If you publish a website, page, form, image, file, project, testimonial, home design, team profile, review, domain, or other content through Buildiy, you are responsible for that content.
You must make sure your content is lawful, accurate, appropriate for your audience, and that you have all rights, licences, consents, and permissions needed to publish it. This includes text, images, floor plans, client stories, logos, reviews, trademarks, business names, maps, and third-party embeds.
Buildiy does not pre-approve all tenant content. We may review, restrict, remove, disable, or refuse to display content if we believe it may breach these terms, breach the law, create risk for Buildiy or others, or harm the reliability or reputation of the platform.
You must not use Buildiy, hosted websites, domains, forms, email features, or any related service to:
We may suspend, restrict, remove, take offline, or terminate an account, workspace, website, domain, page, form, file, feature, or subscription if we reasonably believe:
Where practical, we will try to contact you first. However, we may act without notice if the issue is urgent, serious, unlawful, security-related, payment-related, or likely to affect other users or the platform.
Buildiy accounts are free. Paid product add-ons are billed according to the add-on, subscribed price, billing cycle, discount, and subscription settings shown at checkout or in your dashboard.
Payments may be processed by Stripe. You authorise us and our payment provider to charge the payment method you provide for subscription fees, upgrades, renewals, usage-based charges if introduced, taxes, and other amounts you agree to.
If payment fails, we may retry payment, downgrade features, suspend paid features, or restrict access until the account is brought up to date. Discounts may be limited, withdrawn for future purchases, or subject to their own terms.
We may introduce new prices or add-ons over time. Existing paid add-on subscriptions will remain on their subscribed Stripe price unless you upgrade, downgrade, cancel, resubscribe, or we explicitly migrate you with appropriate notice.
Buildiy may help configure domains, SSL certificates, DNS records, email delivery, maps, reviews, booking links, analytics, payments, security checks, and other third-party services. These services may depend on providers such as Cloudflare, Stripe, Google, Microsoft, email providers, DNS providers, and hosting infrastructure providers.
We are not responsible for failures caused by third-party providers, incorrect DNS records, registrar delays, external account settings, email deliverability rules, API limits, provider outages, browser behaviour, search engine indexing, or actions taken by your own domain/email/DNS provider.
We may maintain backups for operational recovery, but Buildiy is not a guaranteed backup service for your business records, website content, files, emails, customer documents, or third-party data. You should keep your own copies of important material.
If you close your account or if your account is terminated, some data may be deleted, retained in backups for a limited period, or retained where required for legal, billing, tax, security, dispute, or audit reasons.
You keep ownership of content you upload or create, subject to any rights owned by others. You grant Buildiy the permission needed to host, process, display, transmit, resize, back up, secure, and otherwise operate that content as part of providing the service.
Buildiy owns or licences the Buildiy platform, templates, software, design, branding, documentation, and related materials. You must not copy, resell, repackage, reverse engineer, or misuse Buildiy materials except as allowed by us in writing.
Buildiy templates and starter content are provided to help you launch faster. You are responsible for reviewing, editing, and approving all template copy, images, layouts, SEO settings, claims, prices, testimonials, and business information before publishing.
Our handling of personal information is explained in our Privacy Policy. You are responsible for making sure your own collection and use of personal information through tenant websites, forms, client portals, and communications complies with applicable privacy laws and your own customer obligations.
We aim to keep Buildiy reliable, but we do not promise that the platform will be uninterrupted, error-free, or available at all times. Maintenance, updates, security work, third-party outages, internet routing, DNS changes, domain verification, billing issues, and other events may affect availability.
We may add, change, limit, rename, replace, or remove features as Buildiy develops. For material changes that negatively affect paid users, we will try to give reasonable notice where practical.
Nothing in these terms excludes, restricts, or modifies rights that cannot be excluded under the Australian Consumer Law or other applicable laws. To the extent allowed by law, our liability is limited to resupplying the service or paying the cost of resupplying the service.
To the extent allowed by law, Buildiy is not liable for indirect loss, lost profit, lost revenue, lost opportunity, reputational damage, loss of data, business interruption, search ranking changes, email deliverability issues, third-party service failures, domain misconfiguration, or losses caused by tenant content or user actions.
You agree to indemnify Buildiy against claims, losses, costs, damages, expenses, and liabilities arising from your content, your website, your customer interactions, your breach of these terms, your misuse of the platform, or your infringement of another person's rights.
You may cancel your subscription or stop using Buildiy, subject to any billing terms shown in your dashboard or checkout. We may terminate or refuse service in the circumstances described in these terms.
Sections intended to survive termination, including payment obligations, intellectual property, privacy, liability, indemnity, and dispute provisions, continue after your access ends.
We may update these terms as Buildiy grows, as features change, or as legal requirements develop. If changes are material, we will take reasonable steps to notify affected users. Continued use of Buildiy after changes take effect means you accept the updated terms.
These terms are governed by the laws of Western Australia and the Commonwealth of Australia. Before starting formal proceedings, you agree to contact us first and give both sides a reasonable opportunity to resolve the issue in good faith.
